KVKK Clarification Text

This notice has been prepared by Konsey Tur Seyahat Acentası Belge No: A7828, acting as the data controller, pursuant to Article 10 of Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

2. Categories of Personal Data Processed

Identity: first name, last name, Turkish identity number, date of birth, gender, nationality and passport details.
Contact: telephone number, email address and address.
Customer Transactions: reservation, request, complaint, review and order details.
Finance: billing details and payment and refund records. Card details are not stored in our system; they are processed through payment institutions' secure infrastructure.
Travel: travel dates, accommodation, transfer, flight and visa information, and details of accompanying travellers.
Transaction Security: IP address, browser information, session records and logs.
Marketing: cookie records and campaign and communication preferences (only with your explicit consent).
Special Categories of Personal Data: information about special requirements, such as health conditions, disabilities or dietary preferences, only when you provide it yourself.

3. Purposes of Processing Personal Data

Managing reservation, sales and contract processes for tours, hotels, transfers and other travel services,
Sharing the information required to provide the service with accommodation facilities, tour operators, transport companies and other suppliers,
Handling payments, invoicing, refunds and accounting,
Responding to your requests, questions and complaints, and contacting you,
Fulfilling legal obligations, particularly those under travel agency, tax and commercial legislation,
Ensuring information and transaction security and providing evidence in legal disputes,
With your explicit consent, sending campaigns, offers and promotional communications, analysing website usage and measuring advertising activities.

4. Legal Grounds and Collection Methods

Your personal data is collected through our website, reservation and contact forms, telephone, email, WhatsApp, cookies and physical channels, by automated or partially automated means. Your data is processed under Article 5/2 of the KVKK on the following grounds:

(a) processing expressly provided for by law,
(c) processing directly related to the establishment or performance of a contract,
(ç) fulfilment of the data controller's legal obligations,
(e) establishment, exercise or protection of a right,
(f) our legitimate interests, provided that your fundamental rights and freedoms are not harmed.

These are the legal grounds on which processing is based. Sending commercial electronic messages, using analytics and marketing cookies and processing special categories of personal data are based solely on your explicit consent under Articles 5/1 and 6 of the KVKK. Refusing to give explicit consent does not prevent you from using the service you have purchased.

5. Transfer of Personal Data

Your personal data may be transferred, solely for the purposes described above, to:

Accommodation facilities, tour operators, airlines, transfer companies, and guiding and insurance service providers,
Banks, payment institutions and electronic money institutions,
Business partners providing hosting, email, SMS, software and information technology services,
Providers of accounting, legal and audit services,
Authorised public bodies upon request (the Ministry of Culture and Tourism, law enforcement authorities, tax offices, judicial authorities, etc.).

Transfers may be made to these recipients.

Transfers abroad: For tours and accommodation services provided abroad, the information necessary to deliver the service is transferred occasionally to overseas suppliers under Article 9/6 of the KVKK, where directly related to the performance of the contract. Transfers abroad to analytics and marketing service providers (e.g. Google, Microsoft, Meta and OpenAI) are made only with your explicit consent.

6. Retention Periods

Your personal data is retained for the period required for its processing purpose and for the periods prescribed by applicable legislation. For example, commercial books and documents are retained for up to 10 years under Turkish Commercial Code No. 6102 and Tax Procedure Law No. 213; commercial electronic message consent records are retained for 3 years after consent is withdrawn; traffic records and logs are retained for the periods prescribed by applicable legislation. When the retention period expires, your data is deleted, destroyed or anonymised.

7. Your Rights

Under Article 11 of the KVKK, you have the right to:

Learn whether your personal data is processed and request information about such processing,
Learn the purpose of processing and whether your data is used in accordance with that purpose,
Know the third parties to whom your data is transferred domestically or abroad,
Request correction of incomplete or inaccurate data,
Request deletion or destruction of your data under Article 7 of the KVKK,
Request that third parties receiving your data be notified of corrections, deletion or destruction,
Object to a result against you arising from analysis exclusively by automated systems,
Request compensation for damage caused by unlawful processing.

You are entitled to exercise these rights.

8. Applications

You may submit requests concerning your rights, together with information identifying you, in accordance with the Communiqué on the Procedures and Principles for Applications to the Data Controller: in writing to Ferhuniye Mahallesi, Müneccimbaşı Sokak No: 8/2 Selçuklu Konya Selçuklu / Konya 42200, through a registered electronic mail (KEP) address, secure electronic signature or mobile signature, or from the email address registered in our systems to info@konseytur.com.tr. Your application will be resolved free of charge within 30 days at the latest; if processing requires an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
